SUCCESSFUL REPRESENTATION OF ‘INTERESTED PARTY’ IN POCA PROCEEDINGS
James Caldwell acted for the ex-wife of a major cocaine dealer who had been sentenced to an 18-year prison sentence at Winchester Crown Court. James' client applied as an 'interested party' under s.10A of the Proceeds of Crime Act 2002 when the prosecution applied to take the defendant's full 50% legal equity in the former matrimonial home. Through pre-hearing negotiation and legal submissions, James managed to persuade the prosecution to accept a figure equating to just 13.5% of the equity, which enabled James' client and her two children to retain their home.
